176- THEY ASK YOU FOR YOUR JUDGEMENT, SAY: “ALLAH GIVES YOU HIS JUDGEMENT CONCERNING THOSE WHO DIE LEAVING NO DESCENDANTS OR HEIRS”. IF A MAN DIES AND HE HAS NO CHILDREN AND HE HAS A SISTER, SHE INHERITS HALF OF WHAT HE LEAVES, AND HE INHERITS ALL SHE LEAVES IF SHE HAS NO CHILDREN. IF THEY ARE TWO SISTERS, THEY INHERIT TWO THIRDS OF WHAT HE LEAVES, AND IF THEY ARE SIBLINGS MEN AND WOMEN, THE MALE INHERITS AS MUCH AS TWO FEMALES. ALLAH CLARIFIES MATTERS FOR YOU SO THAT YOU DO NOT GO ASTRAY, AND ALLAH KNOWS ALL THINGS.
Allah’s messenger prayer and peace upon him was asked who will inherit those who die leaving no children. It is also clear from the Ayah that he has no wives or parents who would normally have shares. Allah the Highest answers them that the inheritance in this situation is as follows:
<!--[if !supportLists]-->1- If the deceased is a man who has one sister only, she inherits half of his estate.<!--[endif]-->
<!--[if !supportLists]-->2- If the deceased is a man who has two sister; they inherit two thirds of his estate, a third each.<!--[endif]-->
<!--[if !supportLists]-->3- If the deceased is a woman and she has one brother, he inherits all of her estate.<!--[endif]-->
<!--[if !supportLists]-->4- If a man or a woman die and they have brothers and sisters, they inherit the whole of his estate, and the male takes the share of two females.<!--[endif]-->
This is a clear part of Allah’s Law concerning inheritance, and those who do not follow this law are clearly misguided.
It is important to know that these laws were sent by Allah the Highest for all people, at all places and at all times. No one should say that a woman should inherit as much as a man now as there is equality between men and women. Allah the Highest knew that changes which were going to happen to the society when He sent this down.
Also a man inherits twice as much as a woman as he has more financial responsibility than her. If a working wife got pregnant and has children, she is the responsibility of her husband so are the children. If elderly parents become in need financially, they are the responsibility of their son. If a sister is in financial need and she has brothers and sisters, she is the responsibility of her brother.
Allah’s Law always has sound reasons therefore we should never ignore it or change it.
